Standard Royalty Free License Agreement

Here’s the legal stuff. Please take some time to read this properly. By purchasing an image from this site, you agree to be bound by the terms of this agreement automatically.

The following is a legal agreement between you and the owners of Patternhead.com. Following a successful purchase, a one-person license is granted to the purchaser (person or organisation). It is non-transferable. Ownership cannot be transferred to a third party. If the image is to be used by more than one employee in an organisation then an Extended License is required.

None of the images from Patternhead.com may be resold or redistributed by any means, or made available for redistribution or resale by a third party.

You can use an image purchased from PatternHead for:

• Digital media - web site design, multimedia presentations, film, video and cell phones
• Printed media - up to 200,000 copies such as magazines, newspapers, books, booklets, flyers, brochures etc.
• Fine art prints - to decorate your home, office or public place
• Multiple projects - the royalty free license allows usage in one or more projects

You CANNOT use an image purchased from Patternhead for:

• Items for resale - web templates, posters, prints, greeting cards, postcards, print-on-demand services, canvas, t-shirts, mugs, calendars, mouse pads or any other items incorporating the image
• Promotional items - that are given away for free
• Business identity - any part of logo, trademark, service mark, business name etc.
• Large print runs - where the number of copies exceeds 200,000

Further restrictions:

Images may not be used:

• For unlawful or immoral purposes
• To spread hate or discrimination.
• To defame or victimise other people, sociteties, cultures

When you buy an image from PatternHead you are buying a license to use that image. The copyright remains with the creator. You must not claim that the image is your own. You must not sell the image or the license. You must not share the image or make it available for download from a website.

Indemnification

You agree to indemnify, defend, and hold harmless PatternHead and its officers, employees, shareholders, directors and suppliers against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses, arising out of or related to a breach of this Agreement, the use of this site and the use or the inability of use of any Image, your failure to abide by any restriction regarding the use of an Image, or any claim by a third party related to the use of an Image.

PATTERNHEAD PROVIDES THE WEBSITE AND IMAGES ON AN “AS IS” BASIS. WE OFFER NO WARRANTY, EXPLICIT OR IMPLIED, REGARDING ANY IMAGES, THE WEBSITE, THE ACCURACY OF ANY INFORMATION, OR ANY RIGHTS OR LICENSES UNDER THIS AGREEMENT INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. PATTERNHEAD DOES NOT REPRESENT OR WARRANT THAT THE WEBSITE OR THE IMAGES WILL MEET YOUR REQUIREMENTS OR THAT THEIR USE WILL BE UNINTERRUPTED OR ERROR FREE.

PATTERNHEAD SHALL NOT BE LIABLE TO YOU OR TO ANY OTHER PERSON OR ENTITY FOR ANY GENERAL, PUNITIVE, SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES, OR LOST PROFITS OR ANY OTHER DAMAGES, COSTS OR LOSSES ARISING OUT OF YOUR USE OF THE WEBSITE OR THE IMAGES.
