Extended Royalty Free License Agreement

The extended royalty free license agreement allows you to use an image purchased from PatternHead for stuff that isn’t allowed in the Standard license terms. How cool is that? Check out the legal blurb below.

If you find that the permitted uses in the Standard license terms are not sufficient for your project then you can purchase an extended royalty free license.

An extended license allows:

• Print items for resale - You can use the image on items that you sell such as posters, greeting cards, prints, postcards etc. up to a maximum of 10,000 copies. If you exceed this limit you must purchase the license again.
• Electronic items for resale - You may use the image in electronic items for resale such as website templates, e-cards, document templates, screensavers, or similar products up to a maximum of 10,000 items. If you exceed this limit you must purchase the license again.
• Multi-seat usage - You can share the image with an unlimited number of persons WITHIN your organization. You cannot share the file with anyone outside your organization.
• Large print runs - up to a maximum of 500,000 copies. If you exceed this limit you must purchase the license again.
• Promotional items - that are given away for free up to a maximum of 10,000 items. If you exceed this limit you must purchase the license again.

An extended license does NOT allow:

• Resale of the original file - You cannot sell the original image or transfer ownership to a third party.
• Ownership - You do not own the original image. You own a license to use that image. The license is non-transferable.
• Distribution - You cannot distribute or share the file with anyone outside of your organization.
• Business identity - any part of logo, trademark, service mark, business name etc.

Further restrictions:

Images may not be used:

• For unlawful or immoral purposes
• To spread hate or discrimination.
• To defame or victimise other people, sociteties, cultures

When you buy an image from PatternHead you are buying a license to use that image. The copyright remains with the creator. You must not claim that the image is your own. You must not sell the image or the license. You must not share the image or make it available for download from a website.

Indemnification

You agree to indemnify, defend, and hold harmless PatternHead and its officers, employees, shareholders, directors and suppliers against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses, arising out of or related to a breach of this Agreement, the use of this site and the use or the inability of use of any Image, your failure to abide by any restriction regarding the use of an Image, or any claim by a third party related to the use of an Image.

WE OFFER NO WARRANTY, EXPLICIT OR IMPLIED, REGARDING ANY IMAGES, THE WEBSITE, THE ACCURACY OF ANY INFORMATION, OR ANY RIGHTS OR LICENSES UNDER THIS AGREEMENT INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. PATTERNHEAD DOES NOT REPRESENT OR WARRANT THAT THE WEBSITE OR THE IMAGES WILL MEET YOUR REQUIREMENTS OR THAT THEIR USE WILL BE UNINTERRUPTED OR ERROR FREE.

PATTERNHEAD SHALL NOT BE LIABLE TO YOU OR TO ANY OTHER PERSON OR ENTITY FOR ANY GENERAL, PUNITIVE, SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES, OR LOST PROFITS OR ANY OTHER DAMAGES, COSTS OR LOSSES ARISING OUT OF YOUR USE OF THE WEBSITE OR THE IMAGES.
